Define a child and young person in the OTA 1989
Child: person under 14 years
Young Person: Person over 14 years under 18 years
What is the primary consideration of the OTA 1989
The well-being and best interest of the child or young person are first and paramount consideration.

OTA 1989 section 42
Search without a warrant
Believe on reasonable grounds that is critically necessary to protect the child or young person from death/injury. Enter & search dwelling house & remove/detain CYP & place CYP in custody of OT
Define Critically necessary
If you leave the location, injury/death may occur & there is not enough time to get a warrant.
OTA 1989 section 42 obligations
1) Identify yourself
2) State the act (OTA 1989 s42)
3) Within 3 days un form the commissioner

Place of safety warrant
Become aware that a CYP has suffered or likely to suffer serious ill-treatment/deprivation/harm BUT the need to act is not critically necessary.
OTA 1989 section 48
Found unaccompanied
CYP is found unaccompanied in a situation which their physical/mental health is/likely to be impaired. May use such force as reasonable be necessary take CYP. With their consent deliver into custody of parent/guardian. If no consent/caregivers unwilling place them in custody of OT.
