Copyright
The architect has copyright
The client has a licence to use the design on that site only if they pay
May be different with government
Copyright should not be given away (only with remuneration)
Insurances
The CAA notes the need for current Pl insurance.
Also need public liability, workers compensation, etc.
Client obligations
Required to provide timely and accurate information and decisions
They also need to make payments
They must also allow the architect to publish and market the work
Architect’s obligations
A level of reasonable skill and professionalism is required
The architect is also acting on behalf of the client and in their best interests
Responsibility to coordinate and manage costs, consultants, maintain good records and advise on changes to scope of works (and costs)
And resolve any conflicts
General conditions
Information on administrative functions.
Also provides protection and should not be removed.
Can also affect PI if removed.
Dispute resolution
CAA sets out ways to resolve disputes (best course of action)
Or mediation if necessary
Litigation is a last resort
Termination
The process of being finalised and all matters being dealt with (not necessarily due to dispute)
30 day notice period for resolution including payment
