the Civil Rights Act
1964- law makes illegal racial discrimination in areas of public accomodations and in employment on the basis of race, color, national origin, religion, gender(2015) and sexual orientation(1991)
Voting Rights Act
1965; protects the right to vote by prohibiting the use of registration procedures that could deny anyone the right to vote
Americans with Disabilities Act (ADA)
(ADA) 1990- provides for “reasonable accommodations for people with disabilities
Amendment 4 Search and Seizures
law enforcement cannot enter your home for no reason. They must knock and announce and have a search warrant stating exactly what it is they are hoping to find. Unless probable cause.
the role of civil rights
The role of civil rights is to provide policies that extend basic rights to groups historically subject to discrimination.
define civil liberties
your individual legal and constitutional protections from the government. Freedom Speech, Freedom of religion (establishment clause), freedom of the press, right of peaceful assembly, The right to petition the government FOIA Freedom of information act.
define pure speech
Pure Speech includes basic conversation of everyday people, like talking to a neighbor or a friend.
define obscenity
– a key exception to the right of freedom of expression. Acts or statements that are extremely offensive under current societal standards. “I know it when I see it.” Miller v California 1973, the Supreme Court provided no constitutional def. Instead 3 criteria: the item in question must be taken in its entirety, as a whole item. Must apply contemporary and local values and community standards. Does it lack literary, artistic, and social value? For communities to use for their community.
the factors that define social movements
A successful social movement needs to have passionate members who personally believe in their cause, A cause worth fighting for, The media and social media,collective action to gain popular support,working outside the conventional bounds of government by having support and participation from the public, known as the outside game. Acting within the normal channel of government is another standard procedure taken in social movements that involve lobbying and fundraising for elected officials
