What’s the difference between judicial activism and judicial restraint?
The activism can change the meaning over time and the restraint is interpreted based off the constitution’s intentions
What are civil liberties?
Basic freedoms all people have that are protected by the gov
Difference between positive liberties and negative liberties
Positive is freedom to and negative is freedom from
What amendments to the Constitution make up the bill of rights?
The first 10 amendments

Against an unwarranted search/seizure
What rights/liberties are protected by the 5th amendment?
- Can’t be tried twice for the same crime
- can’t be a witness against yourself
- due process of law (proper process)
Why is the 9th amendment important?
The rates listed aren’t the only rates we have
ex: right to privacy
In reference to the Bill of Rights what is selective incorporation?
Laws to protect people from national government and now the states too
What part of the 14th amendment made “ incorporation” of the bill of rights possible?
The due process clause
What is a precedent case in law?
It establishes away a law will be interpreted
What is judicial review?
Interpret constitution and determine if all government laws are constitutional
Ex: judicial branch and state laws
Why is the exclusionary rule important?
Prevents illegally obtained evidence to be used in court
