Affirmative Action
the encouragement of increased representation of women and minority-group members, especially in employment.
Bill of Rights
a formal statement of the fundamental rights of the people of the United States, incorporated in the constitution as Amendments 1–10, and in all state constitutions.
Defamatory Speech
The term defamatory is a type of statement or speech that is injurious to someone’s or people’s name or reputation. This could either be articles, stories or reports that make claims or expressions which are implied to be factual.
Discrimination
treatment or consideration of, or making a distinction in favor of or against, a person or thing based on the group, class, or category to which that person or thing belongs rather than on individual merit
Double Jeopardy
the act of prosecuting a defendant a second time for an offence for which he has already been tried
Due Process
the regular administration of the law, according to which no citizen may be denied his or her legal rights and all laws must conform to fundamental, accepted legal principles, as the right of the accused to confront his or her accusers.
Establishment Clause
The Establishment Clause is the first of several pronouncements in the First Amendment to the United States Constitution, stating,
Congress shall make no law respecting an establishment of religion
Exclusionary Rule
a rule that provides that otherwise admissible evidence cannot be used in a criminal trial if it was the result of illegal police conduct
Fighting Words
Usually, fighting words. language that arouses rage in an antagonist.
Free-exercise Clause
the accompanying clause with the Establishment Clause of the First Amendment to the United States Constitution. The Establishment Clause and the Free Exercise Clause together read:
Gag Order
a court order banning reporters, attorneys, and other parties involved in a case before a court of law from reporting on or publicly disclosing anything relating to the case.
Hate Speech
speech disparaging a racial, sexual, or ethnic group or a member of such a group
Libel
defamation by written or printed words, pictures, or in any form other than by spoken words or gestures.
Literacy Test
an examination to determine whether a person meets the literacy requirements for voting, serving in the armed forces, etc.; a test of one’s ability to read and write.
Obscenity/Obscene Speech
Obscene speech depicts or describes, in a patently offensive way, sexual conduct specifically defined by the applicable state law.
