Motion for new trial rule
A
A motion for a new trial may be granted because of some serious error that occurred during the trial (e.g. an error in the admission of evidence, error in instructing the jury, excessive verdict, etc). In theory, a new trial could be granted if the jury’s verdict was a clear miscarriage of justice.
