CPP applies when?
To any case where the victim is under the age of 18 at the time of making the complaint
3x Criteria
Sexual Abuse
Physical Abuse
Neglect
Sexual Abuse within CPP context. . . .
is an act involving circumstances of indecency with or sexual violation of a child or using a child in making of sexual imaging
Physical abuse within the CPP context . . .
Is when the actions of an offender result in or could potentially result in, physical harm or injury being inflicted on a child.
This can also be known as a non-accidental injury.
3 areas to consider whether physical abuse meets threshold. .
- The action (of the abuse)
- The injury inflicted (outcome or result)
- The circumstances (factors in the case)
Single action that WILL meet CPP (5)
-How it was done-
- blow or kick to the head
- Shaking of infant
- Strangulation
- Use of object as weapon
- Attempted drowning
Single Injury that WILL meet CPP (5)
-outcome or result-
- bone fracture
- burn
- concussion or loss of consciousness
- any injury that requires medical attention
- any bruising or abrasion where the child is very young (eg. not mobile or can be seen as unlikely to be from another child or play)
Any action and/or injury along with considering the circumstances or factors. Such as. . .
- Vulnerability of the child
- More than one offender
- History of abuse
- High degree of violence
- Offenders history / background
- Location
- Nature and level of concern from the notifier
Neglect within CPP context . . .
is when a person intentionally ill-treats or neglects a child or causes or permits the child to be ill-treated in a manner likely to cause the child actual bodily harm, injury to health or mental disorder or disability.
The ill-treatment or neglect must be serious and avoidable . . .
3 initial steps OT & Police must follow
- Referral - information sharing between two agencies
- Consultation - Discussion at appropriate levels
- Agreement - upon initial action in Initial Joint Investigation Plan (IJIP)
Topics to be considered when completing IJIP
Immediate safety of child involved and any other children Joint visit Child interview Medical practitioner Collect physical evidence Any further actions agreed
