Who can sue in a charitable trust?

A

It used to be the Attorney General but now the Charities Regulatory Authority
Also, if there are multiple trustees, they can sue each other

There doesn’t have to be a specific person or class
Not always identifiable beneficiaries

What happens if a charitable trust fails?

A
  • What was the intent of the donor?
  • If it is general enough that can be reassigned then the Cy-pres Doctrine applies
  • Cy-pres: property go to something that is close to the original intent.
  • If not, if it fails, it fails.
