Who is a principal offender?
A person who commits the actus reus and has the relevant mens rea at the same time
What is a co-principal offender?
If two defendants act together for a common purpose in committing the act, they are considered co-principals
What is an innocent agent?
If the defendant asks someone to do something that the defendant knows is an offence but the other party is unaware, the defendant can still be guilty of the offence as a principal offender.
What is aiding?
Assisting or helping in a crime
E.g. A drives a getaway car after B robs a bank. A has assisted in the offence and is therefore guilty of robbery
What is abetting?
Encouraging or inciting offence at the scene of the crime
E.g. A is at the scene of a bank robbery and gives B a pep talk
What is counselling?
Advising or soliciting a crime, usually before the crime and not at the scene
E.g. A obtains plans for a bank and its safe and advises B of the best time to commit robbery
What is procuring?
To procure means to produce by endeavour. You procure a thing by setting out to see that it happens and taking the appropriate steps to produce that happening.
