Assault Level 1-3
Level 1: a hybrid offense that has a maximum penalty of five years, can comprise of A) intentionally applying force to another person without their consent B) attempting or threatening, by an act or gesture, to apply force or C) accosting or impeding another person, or begging, while openly wearing a weapon or an imitation of a weapon
Level 2: Assault with a weapon or causing bodily harm, is defined as assault that has serious consequences for the person’s comfort. Hybrid offence that has a maximum penalty of 10 years
Level 3: Aggravated assault, which is defined as wounding, maiming, disfiguring or endangering the life of the victim. An indictable offence that carries a maximum sentence of 14 years
Sexual Assault Level 1-3
Level 1: the most common offence and where the victim suffers the least physical injury, an assault that violates the victim’s sexual integrity without their consent. A hybrid offence with a maximum penalty of 10 years.
Level 2: sexual assault with a weapon, threats to a third party, or causing bodily harm. Carries a maximum sentence of 14 years
Level 3: Aggravated sexual assault, involves wounding, maiming or endangering the life of the victim of a sexual assault. Maximum sentence of life imprisonment
Breaking and Entering
breaking or opening something in order to enter the premises without permission with the intent to commit an indictable offence
Colour of Right
the honest belief that a person owns or has permission to use an item
Controlled Substance
any drug listed in Schedules I to V of the Controlled Drugs and Substances Act
Culpable Homicide
a killing for which the accused can be held legally responsible
Disorderly House
a common bawdy, betting or gaming house
First-Degree Murder
a killing that is planned and deliberate, is the result of a contract, causes the death of a peace officer or is committed during another serious crime
Fraud
intentionally deceiving someone in order to cause a loss of property, money or service
Homicide
the killing of another human being, directly or indirectly (Indictable offence)
Hybrid Offense
an offense that the crown can try either as a summary or indictable offence
Indictable Offense
a crime that is considered more serious than a summary conviction and carries a heavier penalty
Infanticide
the killing of a new born infant by the child’s mother
Manslaughter
any culpable homicide not classified as murder or infanticide
Mischief
wilfully destroying or damaging property or data, interfering with the lawful use of property or data or interfering with any person in the lawful use of property or data
