Accomodate
eliminate or adjust requirements to enable a person to carry out the essential duties of an activity or job
Accommodation
the place where people live or want to live, rights codes protect against discrimination in this regard unless based on age and under age of 19
Affirmative Action
giving advantage to groups who have been discriminated against in the past
Bona Fide Occupational Requirement
a necessary qualification to do a job efficiently and properly, not considered discriminatory (ex. a law degree for lawyers)
Complainant
the person making the allegation of discrimination (ex. the person who didn’t get the job but felt qualified for it)
Conciliation
bring conflicting parties to a resolution, solving the problem in reference to a human rights complaint
Constructive Discrimination
employment policies that inadvertently exclude certain groups or individuals, contrasts direct discrimination
Direct Discrimination
an overt or blatant act of discrimination
Discrimination
making a distinction between people and treating them differently on a basis other than individual merit or qualifications
Facilities
areas or buildings designated for public (ex. West Van Rec Centre)
Gravamen
the most serious part of an accusation, in discrimination case the distinguishing feature is the gravamen
Harassment
persistent behaviour that violates the human rights of the victim, employers are responsible for ensuring that this does not take place
Human Rights
the right to receive equal treatment and to be free from discrimination and harassment, also encompasses the right to have access to places, services and opportunities
Human Rights Codes
legislation that protect people from discrimination
Mediation
intervention between the conflicting parties that promotes compromise or settlement of the dispute, used in reference to meeting between respondent and complainant
