What is the internal responsibility system concerning the occupational health and safety act?
all parties in the workplace need to ensure a health and safety environment
What are the ER’s duties when it comes to the occupational health and safety act?
- take all reasonable precautions (25(2)(h)-due diligence)
- appoint competent supervisors
- maintain equipment in good condition
- ensure that workers use protective equipment
- prepare a H+S policy and review it
- post policy
- acquaint workers with any hazard associated to their work
- identify and take inventory of hazardous materials
- help JHSC and H+S representatives carry out their duties
- post the OHSA
- refuse underage workers
- keep accurate records of biological, chemical and physical agents
- report accidents, injury, illness to the ministry of labour
What are the duties of workers when it comes to the health and safety act?
- comply with OHSA and its regulations
- use protective devices or clothing
- report dangerous or defective equipment

- refuse to engage in any prank, contract, unnecessary running
What are the duties of the supervisors in the health and safety act?
- ensuring that workers comply with OHSA and its regulations
- advising a worker of potential or actual H+S dangers
- providing workers with written instructions
- taking every reasonable precaution in all circumstances
What are the workers rights in H+S act?
1.right to participate 2.right to refuse unsafe work 3.right to stop unsafe work (through JHSC members) 4.right to know
Explain the JHSC
advisory group who meet regularly (every 3 months), required if 20+employees, at least half must be workers and at least 2 certified members
Explain accident reporting
must report critical injuries to MOL within 48 hours plus a written report (amputation of limb, burns or excessive loss of blood), need to notify JHSC and if non critical injury you have 4 days to do all that
What are the steps in accident reporting
1.arrange medical assistance 2.lock out machinery 3.secure site 4.notify workers family, JHSC and MOL
Explain accident investigation
Min. 2 managers are trained with techniques and need to follow a course of action immediately after incident
Explain what the MOL is entitled to do
they can do a random, unannounced inspections and to enforce may issue an order, a stop-work order and its binding as soonn as its issues
Explain the due diligence defence
from a legal form says that employer took all precautions (effort) -need proof of documentation
