OMA directive 23 of 2003:
Any decision not to start resuscitation efforts must be supported by one of the following:?
A
5.5.1 observation of the NY State criteria for the presumption of death (i.e. rigor mortis, extreme dependent lividity, tissue decomposition, obvious mortal injury), or
5.5.2 a valid NY State Out of Hospital or Nursing Home Do Not Resuscitate (DNR) order, or
5.5.3 a signed death certificate, or
5.5.4 a physician at the scene willing to sign a death certificate attesting to his or her findings. (The New York State License number of the physician shall be noted on the PCR.)
NOTE: In out-of-hospital settings, a nurse or nurse’s aide cannot make a
pronouncement of death.
