Tort
A civil wrong not arising from a breach of contract.
Compensatory damages
Money award equivalent to the actual value of damages sustained.
Punitive damages
Money damages that may be awarded to a plaintiff to punish the defendant and deter future similar conduct.
Two classifications of torts
- Intentional torts
- Unintentional torts
Intentional torts
Result from the intentional violation of person or property.
Unintentional torts
Negligence results from the breach of a duty to act reasonably.
Tortfeasor
One who commits a tort.
Transferred intent
When a person intends to harm one individual, but unintentionally harms another person, they can be liable to the second victim.
Assault
Word or action intended to make another person fearful of immediate physical harm; threat.
Battery
The unprivileged touching of another; physically/offensively harming another.
False Imprisonment
Intentional confinement/restraint of another person’s activities without justification.
Intentional Infliction of Emotional Distress
Involves an intentional act that results in emotional distress.
Defamation
Any publicly spoken false statement that causes injury to another’s reputation.
Two types of defamation are
- Libel
- Slander
Libel
Defamation in writing.
