- Enter at any reasonable time to inspect licensed premises/part thereof to ensure compliance.
- Enter at any time to inspect where RGB offence againt Act is being committed.
What is S.269?
Power to demand person’s particulars if suspect they are committing an offence against the Act.
May be K9’d if refuse/fail or knowingly give false details
If entry under S.267 is refused consider doing what?
Warning for obstruction and arrest if obstruction continues.
What are some factors to consider when deciding to close licensed premises?
Risk of closure, ie: elevated likelihood of disorder
Impact on the licensee, ie: may cause undue financial impact & criticism of police
What should you take into account when deciding to close licensed premises?
- Weight of supporting evidence
- Prior police interactions
- LIkelihood of escalating violence
- Duration of closure
- Consider/apply TENR
When considering duration of closure of licensed premises, police must consider what?
When order likely to be restored
Time sufficient to address public nuisance concerns
Impact on licensee
