Amending Formula
The procedure for amending the Constitution that requires the approval of Parliament plus two thirds of the provinces representing 50% of the population
Bill
a proposed law
Canadian Charter of Rights and Freedoms
A section of the constitution act, 1982, which sets out constitutionally protected rights and freedoms.
Government or Public Bill
a bill that is proposed by a cabinet minister
Intra Vires
“within the power” means the power a government has to pass laws within its own jurisdiction.
Ultra Vires
“Beyond the power” refers to areas that are beyond power of jurisdiction in government
Judiciary
branch of law made up of judges who interpret the law and dish out punishments.
Legislative Branch
branch that has the powers to make, change and repeal laws; consists of house of commons and senate at the federal level, and the Legislative Assembly at the provincial level.
Lobby Groups
organizations that try to influence the legislators in favour of their cause.
Patriate
To bring legislative power under the authority of the country to which it applies
Principle of Equalization
essential services such as health and education should be available equally to all resident in Canada.
Private Member’s Bill
legislation that is proposed by MP or MLA who is not in cabinet.
Residual Powers
Federal responsibility to make the laws in areas not specifically assigned to either the fed gov or to the provinces
Shared Cost Agreements
agreement between the federal and provincial governments to share the cost of certain programs such as health care.
Statute of Westminster
an amendment to the BNA act that extended Canadas law making powers
