law reform
Law reform is the process of examining existing laws, and advocating and implementing change in a legal system.
Reasons for law reform
- changes in beliefs
- changes in society
- advances in technology
- greater need for protection in community
- petitions
Demonstrations
A demonstration is a gathering of people that express their common concern with an existing law as a means of influencing law reform. It brings an issue to the public eye.
role of courts
individuals can take matters to court, where statutory interpretation of unclear or unfair laws can be used and precidents can be set. However,
this can be expensive and time consuming, and require standing.
role of media
communicates issues to the public through print, broadcast and online media. However, these opinions are very monetizable and safe.
The Victorian Law Reform Commission (VLRC)
The VLRC is Victoria’s main independent law reform organisation. The VLRC creates research and provides recommendations to the Victorian law as funded by the Government.
Roles:
- recommends law reforms
- Inquiries
- Community law-making
- Education and community engagement
Parliamentary Committees
Examines new and existing bills. Can be permanent standing committees, or re-established select committees.
Royal Commissions
Royal Commissions are major public inquiries established by the government to investigate an area of national or state concern. They have the power to summon witnesses, take evidence, and make recommendations. Eg. Commonwealth Robodebt Scheme (2022-23).
