What are the three tracks the court can allocate a claim to?
Small claims, fast and multi
What is the purpose of the small claims track?
Claims for less than £10,000 that are straight forward and quick.
Name examples of claims that will be outside the scope of the small claims track.
- residential disrepair claims
- personal injury claims
- whiplash claims
What is the fast track?
Value of £25,000 or less and the trial is likely to last longer than 1 day.
What is the multi track?
For claims beyond the scope of the small and fast track.
How long do parties get on each track to complete DQ’s?
Small claims - 14 days
Fast and Multi - 28 days
What power does the court have if the parties fail to submit DQ’s on time?
Serve notice to comply, strike out the claim, make an order for directions in the parties absence.
In the fast track which dates will they need to obtain consent from the court to vary?
- return of the DQ’s
- return of the PTC’s
- trial date
- any other thing that may affect the trial date
Is there a set timetable in the multi track?
No. The general principle is ensuring the case proceeds to trial as soon as possible.
What is usually the first step of the multi track following filing of DQ’s?
Case management conference.
