Civil law
The system of law concerned with private relations between members of a community rather than criminal military or religious affairs.
Tort
A wrongful act or an infringement of a right other than under contract leading to civil legal liability
Breach of contract
An act of breaking the terms set out in the contract
Statute law
The body of principles and rules of law lay down in statutes
Damages
A sum of money claimed or awarded in compensation for a loss or an injury or physical harm caused the same thing impairing it’s normal function
Compensatory damages
Intend to compensate the injured party for loss or injury
General damages
Are intangible non-monetary losses that do not have an exact dollar amount
Special damages
Damage they can actually be ascertained like Car dents or medical expenses
Exemplary or punitive damages
The amount of money awarded to the claimant in civil litigation to punish the wrongdoer
Nominal damages
A small monetary remedy designed to indicate that although the plaintiff has suffered no harm a tort has been committed and the rights of the plaintiff have been infringed
Doctrine of negligence
Failure to do at all or failure to do in a proper manner some act which it was the duty of the alleged delinquent to perform
Negligence
Failure to take proper care in doing something
Strict liability
Liability which does not depend on actual negligence or intent to harm
Nuisance
A person thing or circumstance causing inconvenience or annoyance
Trespass
One who without authorization goes on the private premises of another without an invitation or inducement expressed or implied but purely for his or her own purposes.
