Deviance
- rule breaking
- can be legally or just socailly
- violating a norm
Crime
- violating a LEGAL norm, law
Social Control
- techniques to prevent or stop deviance
- Informal = scolding, shaming
- Formal = use of force
what is the Canadian legal system made of
colonial norms
- more confrontational than restorative - can plead not guilty
indegenous legal system characteristics
- more restorative
- accused assumes responsiblikoty n pleads guilty
some sociologcial considerations ( on deviance)
- actions r not INHERTANTLY deivant itscuz we deem it so
- devianc eand social control are two sides of same coin
- more social control does nOT mean theres more deivance, its just that theres more actions done to take control
Approach to Studying Deviance: Deviance as Norm Violation
- studies the behaviour that violates norms and the ppl who violate them
- “counts” the violations
- tries to understand the ppl who violate the norms
and why
Approach to Studying Deviance: Deviance as Social Definition
- studies the development of social norms and labels for what is deviant
- focuses on situational nature and how the beahviour makes someone deviant
Functionalist’s Consensus Model of Law
- there is an overall agreement as to what is a deivnat in society
- does not explain much tho
Conflict’s Model of Law
- the ppl in power are the ones making the laws to maintian their status and take ocntrol over others
Attrition
only some crimes make it down the Funnel
measuring crime methods
- Uniform Crime Reports = stats
- Victimization Survey = asks whne u exp victim
- Self Report survey = out urself and ur criminal or deivant acts
Strain Theory
- tries our best to conform to be socially accepted but then we strain or stress oursevles
- innovation = need to resort to deviant means to achieve goals
Labelling Theory
primary deivance = an action that is does not affect me
secondary deivance = after being labelled, then im affected
factors when accepting deviant actions as postive
- Priority = how earily weree u exposed to actions
- Duration = how long were u exposed to them
- Intensity = how attached r u to those ppl who exposed u
factors for NOT commiting crime
- Beliefs = ur values
- Commiment - wht do u hav to lose
- Attachment - do u care how others see u
- involvment - how involved r u in NON-deviant stuff
Deterance Theory
punishments may deter u from criminlaity
- specific = prisom
- general - public execution
dimensions of punishment
- severity of punishment for ur crimes
- certainty - how likely ur gonna b caught n punished
- celerity - swiftness of the punishment (need more of this)
