Uninvited sexual contact is always considered sexual assault, even if it occurs between two people of the same gender. Sexual assault is an intentional sexual contact: characterized by the use of force, threats, intimidation, and abuse of authority and when the victim does not or cannot consent

A

• Restricted

  • Are confidential
  • Activate victim services without an official investigation
  • Allow optional forensic medical exams
  • Can be made only to a SARC, a VA, or Coast Guard Health Services Provider
  • In rare instances cannot remain restricted (if highly unsafe)
  • Can be filed by spouses sexually assaulted by his/her active duty spouse; these files will be managed by the Family Advocacy Program (FAP)

  • Activate victim support services
  • Allow victim to request geographic separation from the alleged offender
  • Active an official CGIS investigation to pursue the alleged offender
  • Do not require the victim to participate with the CGIS investigation; Victims should understand the investigation will still proceed.

  • CGIS must immediately notify the local Sexual Assault Response Coordinator (SARC) upon receipt of the initial report of sexual assault.
  • CGIS has the sole responsibility for conducting the criminal investigate of a sexual assault allegation with in the USCG

What are Command Requirements for sexual assault?

A
  • Commands are required to execute a healthy command climate that discourages sexual assault, eliminates barriers to reporting and promotes intervention. Commands are required to report all instances of sexual assault to the SARC immediately.
  • Commands must not take any formal or informal investigative action, to include preliminary inquiry or interview of alleged victims, offenders or witnesses regarding assault.

What are Victim Advocates Responsibilities?

A

• Victim Advocate Responsibilities: A VA leads or assist SARC with prevention efforts, such as organizing awareness events; acts as a victim companion in navigating investigative, medical, and recovery processes, such as coordinating appointments as requested; explains the different reporting options; and avails themselves to the victim to provide support as needed.
