MG series is for unused material
MG6 A = record of pre-interview briefing
MG6 B = (Officer reprimands?)
MG6 C = non-sensitive unused material (relevant)
MG6 D = sensitive unused material
MG6 E - unused which meets the disclosure test —> anything to undermine prosecution or assist defence
Relevant material
Relevant material: anything that appears to have some bearing on any person or offence under investigation or the surrounding circumstances. If it is incapable of having any impact on the case it isn’t relevant.
The 5 Rs of CPIA
Reasonable - pursue all reasonable lines of enquiry whether they point towards or away form the suspect
Retain - all relevant material gathered in an investigation
Record - all material gathered in a durable and retrievable format
Reveal - all relevant material to the CPS to review
Review - all material throughout the investigation
What is considered ‘sensitive material’ in the MG6 series?
Sensitive material
Material that if disclosed would give rise to a real risk of serious prejudice to an important public interest, incl:
○ Material relating to national security
○ Material received from the intelligence & security agencies
○ Material relating to intelligence from foreign sources which reveals sensitive intel gathering methods
○ Material given in confidence
○ Material relating to the identity/ activities of informants or undercover police
○ Material revealing observation posts
○ Material upon the strength of which search warrants were obtained
- Material relating to the private life of a witness (not confidential GDPR stuff)
Sensitive is not the same as confidential
