What is the family law amendment
The court must believe that it is in the best interests of the child to have equal time with both parents unless evidence is given to prove otherwise. A child’s wishes are still taken into consideration, but it is assumable that equal time with both parents is best for the child.
Care of children
When making a parenting order the court must assume that it is in the best interests of the child to have equal time with both parents. The judge will take the child’s wishes into consideration but analyses their age and maturity.
Spousal maintenance
A partner may be liable to provide for the other partner if they do not have adequate means of support. This is considering:
- Age and health
- Income, property and financial resources
- ability to gain employment
- care and control of children(above 18)
- duration of relationship
