What are the principles of the mental capacity act?
- assume everyone has capacity until proven otherwise
- make all reasonable adjustments
- unwise decisions are allowed
- act in patients best interest
- decisions made on behalf of someone must be least restrictive
What is the 2 stage capacity test?

What is lasting power of attorney?
Allows a person with capacity to appoint an attorney to make decisions should they lose capacity
What are the types of lasting power of attorney?
Property + affairs
Personal welfare
What are deputies appointed by the court of protection?
Someone appointed to make a decision after capacity lost
What is a public guardian?
Role = to protect those who lack capacity from abuse
What are advance decisions?
Written document written at time of capacity expressing future wishes - only for specific treatment for a specific condition
What is a deprivation of liberty safeguard
Ensures those who lack capacity are looked after in a way that does not restrict their freedom
