Federal, Provincial, Municipal
What are some responsibilities of the federal government?
Passing laws, border security, importing and exporting
What are some responsibilities of the provincial government?
Healthcare, Education, Minimum wage
What are some responsibilities of the municipal government?
Bylaws, roadways, libraries
What are the three sections of the federal government
Judicial, executive, legislative.
What is the judicial branch?
The court system
What is the executive branch?
The executive branch (also called the Government) is the decision-making branch, made up of the Monarch (represented by the Governor General), the Prime Minister, and the Cabinet.
What is the legislative branch?
The branch of the federal and state government empowered to make the laws that are then enforced by the executive branch and interpreted by the judicial branch.
How are laws made?
Law enters the house of commons and has three reading stages and a committee stage.
Enters Senate and has three readings plus committee stage.
Governor General signs the bill to become a law
When was the CCRF signed?
1982
What is the first section of the CCRF?
Reasonable limits. freedoms can be limited if reasonable.
What do other sections of the charter deal with?
Section 2: Fundamental Freedoms (religion, speech)
Sections 3-5 democratic rights (right to vote)
Section 6: mobility (right to move within provinces)
Section 7-14 Legal rights (Life, liberty, security)
Section 15 Equality rights (Everyperson is equal under law)
What is the notwithstanding clause?
Parliament or the legislature of a province may expressly declare in an Act of Parliament or of the legislature, as the case may be, that the Act or a provision thereof shall operate notwithstanding a provision included in section 2 or sections 7 to 15 of this Charter
What is legal hierarchy?
Some laws are ranked as more important than others. Constitutional law is at the top
