CAN-SPAM Act Flashcards
Can-spam stands for controlling the assault of non-solicited pornography and marketing act. Effective January 1, 2004, this law covers email whose primary purpose is advertising or promoting a commercial product or service. The Can-Spam act is enforced by the FTC or federal trade commission.
The law requires four main components in each carries a fine up to $11,000.
- The senders “from” & “to” addresses must be accurate and identified.
- The subject line cannot miss lead the recipient about the contents or subject matter of the message
- The email must give the receiver the ability to opt-out
- commercial email must be identified as an advertisement and include the senders valid physical postal address.
***When a commercial email is sent, the sender must get the recipient and opt out or unsubscribe option. Under this provision, it is illegal for the sender to sell or transfer the email addresses of people who choose to opt out. The sender must honor this request and must have a system in place to remove the persons email address no later than 10 business days from the request.
