Elements of burglary

A

Enters - entry is complete, as soon as any part of the body of the person, or instrument used by the person is within the building or ship

Any building - building or structure whether permanent or temporary

OR ship - any vessel used in navigation, however propelled.

OR any part of any building - part of any building or structure, whether permanent or temporary

OR any part of any ship - part of any vessel used in navigation however propelled

Without authority - an absence if authority either expressed or implied from a person legally able to give consent.

With intent to commit a crime in the building or ship - there must be an intention to commit an offence that can be proceeded against by the way of indictment within the building or ship

With intent to commit a crime in the building or ship

Remains without authority- to remain when consent to be within the building or ship no longer applies s
