dispute arose in the context of the UKSC’s decision in Micula v Romania, which authorised the enforcement of an arbitral award made under the International Centre for Settlement of Investment Disputes (ICSID) (Case Ioan Micula, Viorel Micula and Others v Romania). By that arbitral award, Romania was ordered to pay Swedish investors compensation of approximately €178 million on account of the early repeal of a regional investment aid scheme. The judgment of the Supreme Court of the United Kingdom was delivered despite the fact that the European Commission, which considered that compensation to be State aid incompatible with the EU internal market, had prohibited Romania from paying it

Case C-673/20 EP v Préfet du Gers:

brexit cases - citizen status

A

= the Court of Justice of the European Union held that UK nationals have lost their EU citizenship as a result of Brexit.

Consequently, individuals resident in Member States can no longer vote nor stand as a candidate in municipal elections. EP asserted that she no longer enjoyed the rights in the EU (the Member State of residence) nor in the UK due to the British ‘15-year rule’ of nationals who have lived outside of the UK for more than 15 years being no longer entitled to take part in elections in the UK.
