Employment-at-will
This means that employees have the option of quitting their employment at any time for any reason and the employer has the option to fire employees at any time for no reason, but non-discriminatory (PUBLIC POLICY)
Whistleblowing
employees who refuse to commit an illegal act, or employees who are terminated for exercising a right or privilege
o Blowing the whistle on an employer’s wrongful actions often is accompanied by retaliation
o Whistleblower protection acts
o Basically, employer cannot terminate employee because they refused to not be illegal
Implied Contract Exception
claim that continued employment was implied by the employer either through written or oral statements by employer
Covenant of Good Faith and Fair Dealing Exception
termination of employees be based on just cause, not based on malice or ill will by employer

Variety of obligations under federal and state laws
Fair Labor Standards Act (FLSA)
o Federal standards for both hourly wages and overtime pay
o Covers employers engaged in interstate commerce
Family and Medical leave Act (FMLA) – job security
o Federal law that requires employers with 50+ employees to provide up to 12 weeks of unpaid leave for birth, adoption, illness etc.
o 30 day notice needed when feasible
Occupational Safety and Heath Act (OSHA)
o Federal legislation designed to prevent workplace injury
Workers’ Compensation
o Governed by state law and ensure that compensation is provided to workers who are injured on the job
Consolidated Omnibus Budget Reconciliation Act (COBRA)
o When an employee leaves a job or has a reduction in work hours that ends eligibility for health benefits, COBRA ensures the extension for another 18 months
Employees’ Right to Unionize
o National Labor Relations Act (NLRA): governs relationship between management and employees
o Cannot compete after termination
o Cannot disclose trade secrets

they are free from control and direction, they set their own schedule, they use their own equipment in performing their job
