Battery Flashcards

1
Q

*Vosburg

A

Child kicked other child just below knee. Other child previously injured, but the kick was the “exciting cause.” C/A for battery even though no intent to do harm because intent to do unlawful act. Potentially different result if on playground, but this was right before class was called to order.

Q

White

A

Man used “piano fingers” on woman’s back, which strangely caused a severe injury. The intent to do the act was enough, even though the man didn’t intend harm. Battery.

Q

Garratt

A

Little boy moved chair out from under woman as she was about to sit down. He knew with “substantial certainty” that she would attempt to sit down, and moving the chair was therefore a battery. Intentional infliction of harmful bodily contact upon another; no intent to injure doesn’t save the boy so long as he had knowledge woman would attempt to sit and would probably make a harmful bodily contact with the floor.
