What is Copyright?
It’s what lawyers refer to as a property right in categories of protected works.
What works is Copyright protection afforded to?
- Literary Works
- Dramatic
- Musical
- Artistic
- Sound Recordings
- Broadcasts inc. via wire or cable
- Typographical arrangements of published editions
What is the framework of the copyright law in the UK?
Copyright, Designs & patents Act 1988
What is the Copyright framework also known as?
‘The Act’
When does Copyright start?
Under UK Copyright Law the works are automatically protected once they are fixed in material form.
What methods can you use in the event of dispute over authorship, ownership or originality?
- Deposit a copy with a solicitor or bank manager and obtain a receipt. (Charges are likely to be incured).
- Send a copy of the work, labeled in an envelope to yourself via registered delivery and leave unopened upon receipt.
What does NOT create copyright in the notified work?
Registering with PRS or MCPS
What ‘acts’ does the Copyright Owner in the UK have authorisation to do? and what are these ‘acts’ called?
- Copy the work
- Issue copies of the work to the public
- Rent or lend the work to the public
- Perform, show or play the work
- Communicate the work to the public
- Make an adaption in and out of relation to any and or all of the above…
What is ‘Poor Man’s Copyright?’ And how well does this evidence hold up in civil court?
Sending a copy of the work/s to yourself via registered delivery. This is considered poor evidence in court becasue it is deemed easy to fake e.g. replacing the materials at a later date.
