A

non-insane automatism- where the cause is external
and the success results in a complete acquittal

insane automatism(INSANITY)- where the cause is internal and lies within the M nagthen rules , when the defense on insanity is successful the D is guilty by reason of insanity

A

automatism will only work when it is caused by an external factor that causes the defendant to totally lose control over their actions examples an invoultray natural reaction occurs such as a sneeze or a motorist loses control when a swarm of bees flees sting quoted by HILL V BAXTER

lord denning summarised automatism in bratty and stated that an act done by the muscles without any control by the mind such as a spasm or reflect or an act done by someone who is not conscious of their action or an act done whilst suffering from a concussion or sleepwalking

2) public principles have been used to protect public rather than legal principles suggesting that law is being undermined. eg in bratty where lord denning defined the definition of automatism on the continuing danger theory which has influenced decisions in other cases eg R V Sullivan
3) can cause unjust outcomes for example lord denning included sleep walking as a possible cause for automatism this was then undermined in R V BURGESS

1) to combat any misunderstanding on sleepwalking the law commissions have proposed that a statute is made to include sleepwalking as eg in R V BURGESS
2) 2019 paper published by law commission names the criminal liability , insanity and automatism which suggests a new statutory defence should be introduced for a lack of capacity to control conduct that is not a result of recognised medical condition as illistated in ray v butterorth and quick
