Definition of Attempts?
An attempt is defined under Section 1 Criminal Attempts Act 1981 as “Where the D does an act that which is more than merely preparatory, with the intention to commit the full crime”.
What is stage one of attempts?
Stage one- the D must do an act which is more than merely preparatory (Jones).
What is the Key case in Attempts?
Geddes- gives us two questions to consider.
What are the two questions Geddes gives us?
1) Had the accused moved from the planning and preparation stage to the execution and implementation stage?
2) Had the accused done an act showing that he was actually trying to commit the full offence?
What is the men’s rea for Attempts?
The men’s rea is that the D must have intended to commit the offence, recklessness is not enough.
