what is the definition of an attempt?
a person does an act which is more than merely preparatory to the commission of the offence with the intention to commit that offence
what does s.1 (2) state?
a person may be guilty of attempting to commit the offence although facts state the the commission of the offence is impossible
what does s.1(3) state?
if the facts were as the defendant believed them to be , then he shall be regarded as having an intent to commit the offence
what does s.1(4) state?
an attempt to commit the offence is punishable to the same extent as the substantive offence.
what is the mens rea for an attempted offence?
the full intention to commit the crime , recklessness is not sufficient.

conditional intent can be used if the charge is worded correctly however this can not be used for specific items
what is the actus reus for ao?
an act that is more than merely preparatory, NOT an omission MUST be an act
