Counsel the Soldier on the state of his room

  • Considering enrolling the Soldier into ASAP
  • Consider corrective training for the Soldier such as revocation of alcohol privileges by the Commander and periodic room inspections until the standard is met
  • If this not the first incident and corrective training was used in the past, consider UCMJ action
  • Have the Soldier immediately clean the room unless the situation dictates otherwise

Counsel the Soldier on the incident and the fact that separation action will be initiated

  • If the Soldier is in a leadership position, he temporarily removed from the position pending the investigation (if applicable)
  • Soldier is enrolled in ASAP
  • FLAG the Soldier
  • Start processing the Soldier for separation / depending on service and/or other factors, Soldier may be entitled to a separation board
  • Recommend the Soldier punishment under UCMJ

A Soldier approaches you and states that he would like to discuss a situation off the record. What are your actions?

A
  • First you should inform the Soldier that no conversations are off the record. You have a duty and responsibility to report inappropriate behavior, misconduct, and/or illegal activity
  • Explain to the Soldier that you are willing to listen unless he begins to cross over into one of the areas mentioned above
  • If the Soldier appears to be uncomfortable at this point, explain to him that if he can give you an idea of the problem you may be able to refer him to a confidential source such as a lawyer, medical personnel, or chaplain
  • If the Soldier simply needs to talk, by all means work with him, but do not allow yourself to be taken into an area that requires expertise or is illegal
  • In addition explain to the Soldier that if he enters into a discussion that is illegal you will stop him and read him his rights and notify the chain of command
  • If the situation is serious ensure that you use a DA Form 4856 and formally counsel the Soldier
  • You should attempt to put the Soldier at ease but be honest with him about what you are obligated to report.
  • Most Soldiers simply need someone to listen and problems can usually be solved at the lowest level After you have determined the problem, discuss possible alternatives and actions
  • If necessary inform the chain of command
  • The problem may be sensitive in nature and the Soldier may be of a sensitive nature and the Soldier may ask you not to tell anyone else. Again you must explain that some things you may be able to solve yourself, but others may need the chain of command’s attention or require them to be informed. Assure the Soldier that only the people required to know will be informed and that those people will only discuss the situation in the performance of official duties
