Article 1
Merge 2 world-views, the realist and liberal while maintained international peace and security. It also promoted self-determination and human rights.
Article 2
Establishes sovereign equality for states, explains when you agree to honor the UN laws you do so in good faith, all members are to support UN and the actions it takes, and even if you’re not a UN member you’ll behave, states shall not threaten or use military force.
Article 103 (aka the UN Charter she references)?
Says the UN charter is the governing document in IL. All other treaties and customs are subordinate to the UN Charter.
Chap 6?
Peaceful settlement of disputes explains steps a member/state has to take in order to resolve disputes. The goal being to prevent major conflict.
Chap 7?
Authorizes security council to decide if there’s a threat to international peace or security and authorizes them to determine if steps are needed to address the threat.
Article 51?
Creates a loophole against threatened use of force because ultimately, a state has a right to defend itself.
Article 38(1) importance and relevance
Important as it identifies where international law comes from. This can include treaties, customs, general principles of law, judicial decisions, or writings and teachings of legal scholars.
