What are light felonies
Those infractions of law for the commission of which the penalty of arresto menor or a fine not exceeding P40,000.00, or both, is provided
Examples of light felonies punished by the R.P.C:
- Slight phyiscal injuries
- Theft
- Alteration of Boundary Marks
- Malicious Mischief
- Intriguing against honor
- Disobedience to an agent of a person in authority
- Alarms and scandals
- Concealing true name
- Prostitution
- Other forms of trespass
- Other light threats
- Light coercion
- Destroying and damaging paintings
- Slander by deed, not serious
General rule and exception for light felonies:
General rule: Light felonies are punishable only when they have been consummated
Exception: Light felonies committed against persons or property, are punishable even if attempted or frustrated
Reason for general rule on light felonies
They produce such light, insignificant moral and material injuries that public conscience is satisfied with providing a light penalty for their consummation.
Reason for exception on light felonies committed against persons or property
It is because these presuppose in the offender moral depravity
Example of light felonies against person (1)
Slight physical injuries and maltreatment
Examples of light felonies against property: (3)
- Theft by hunting or fishing
- Theft, where the value of the stolen property does not exceed P500 and offender was prompted by hunger, poverty, or difficulty of earning a livelihood
- Malicious mischief where damage is not more than P40,000 if cannot be estimated
