How is this achieved?
- Being able to freely converse with each other on topics or issues.
- Publishing newspaper or magazine articles, or broadcasting television or radio programmes via the internet.
- Through artistic mediums, such as painting or drawings or via theatrical performances.
Even when views may ‘offend, shock or disturb the State or any sector of the population.’
Handyside v UK: Article 10
H published in the UK The Little Red Schoolbook, with a chapter on pupils containing info on ‘Sex’. He was charged and convicted with having in his possession an obscene publication for gain.
Outcome: ECtHR held there was no violation of Article 10, as the UK’s right to interfere with H’s freedom of expression was allowed by domestic law.

Promotes and encourages healthy debate and challenge so that citizens can express ideas, views and opinions.
FoE does not give freedom of speech due to its restrictions.
