When can police make an arrest
To enable the person’s name and address to be ascertained; Protect a child/vulnerable person; Prevent the suspect from disappearing; Or to prevent the person from causing harm to themself or others, property damage, or committing public indecency or an obstruction to the highway.
What is the caution police use
“You do not have to say anything. It may harm your defence if you fail to mention when questioned something which you later rely on in court. Anything you do say may be given in evidence.”
When can Magistrates issue a warrant
If; the person has committed/suspected of committing a criminal offence, the offence is indictable and would result in imprisonment, the person is over 18, the person does not have a home address so cannot issue a summons, the necessary info. has been provided in writing.
What happened in R v Iqbal
A drug dealer (Iqbal) escaped from officers before they performed an arrest, therefore he did not ‘escape an arrest’
