Who is considered a child and how do you define child abuse/neglect?
- under the age of 18

REPORTING CHILD ABUSE OR NEGLECT
Child abuse/neglect report occurs
When a mandated reporter (teacher, psych, physicians, etc) learns in a professional capacity child abuse a report must be made no matter where it occurred.

Where should a child abuse/neglect report be made to?
- public children services agency or
- a municipal or county peace officer in the county in which the child resides or in which the abuse or neglect is occurring or has occurred.
- or make it to the entity specified in that section.

Define Adult abuse:
(A) “Abuse” means the infliction upon an adult by self or others of injury, unreasonable confinement, intimidation, or cruel punishment with resulting physical harm, pain, or mental anguish.

Define child neglect
aretaker to protect the child from severe malnutrition. Severe neglect is also described as willfully causing or permitting the health of the child to be endangered, including intentional failure to provide adequate food, clothing, shelter or medical care.
v GENERAL NEGLECT General neglect means the negligent failure of the caretaker to provide adequate food, clothing, shelter, medical care, or supervision, where no physical injury to the child has occurred.
REPORTING CHILD ABUSE OR NEGLECT
When and how should child abuse/neglect report be made?
- report can be made by phone or in person and must include the following:
- names + addresses of child and parents/guardians
- child’s age + current incident of abuse + hx of abuse
- any other info that may help

What actions does a professional need to take if Tarasof or suicide threat? 4 points
- emergency hospitalization
- involuntary/voluntary hospitalization
- documented tx plan w/ 2nd opinion risk assessment
(for organization the clinical director of the organization)
(not in org - any mental health professional who is licensed to engage in independent practice) - contact the police and provide
- identify of client, location of the client or where client resides
- nature of the threat
- identifiable victims include structure
Professional Immunity
What 4 points apply when a professional/organization decides takes action ie report tarasoff or suicide
- consider and document alternatives and rationale for choice
- give special considerations to alternatives w/ consideration of public safety that would least violate client rights
- doesn’t have to report if it will increase physical danger to self, client, or potential victim.
- not liable for breaking confidentiality for purpose of tarasoff reporting
define neglect
(K) “Neglect” means the failure of an adult to provide for self the goods or services necessary to avoid physical harm, mental anguish, or mental illness or the failure of a caretaker to provide such goods or services.
