apportionment Flashcards
join and several liability
any tortfeasor found to have been a cause of π’s harm can be liable to the π for all compensable harm- after that the ∆ that had to pay, burden is on them to file separate suits to collect from other tortfeasors for their portions
Contribution
One tortfeasor has the right to collect from joint tortfeasors when one tortfeasor has paid more than their proportional share- under joint and several liability
One satisfaction rule
A π who has received full satisfaction of a tort judgement for one harm cannot continue to recover against other joint tortfeasors for that harm (cant sue one, recover for everything, and then go after others- only ∆ can)
several liability
Tortfeasor only liable for their portion of fault that led to π’s harm- if they think a non party is a fault, they can say nonparty contributed as an affirmative defense
