What are the four types of alcohol licenses?
On license - allows for sale, supply and consumption of alcohol on site
Off license - sales for consumption off site
Club license - basically rugby clubs. Have to be a member or a guest
Special license- music festival pop up sites
What is a licensed premise
Any place an alcohol license is held
Supervised area
Restaurants you can buy booze but also take the family
What is a restricted area?
18 plus only unless a registered worker under the correct conditions
What info should be displayed on a licensed premises?
License on wall. Section 56 and 57 of the sale and supply of alcohol act
Who can work in a restricted alcohol area
Anyone working, eg cleaning, fixing, serving meals etc.
Not to sell booze or sing
Who can work in a supervised area?
Anyone as long as supervised
What is the offence of minors in restricted or supervised areas?
Fine of up to 2k for supervisors or an infringement notice under section 244 of the sales and supply of alcohol act
What is the offence of a minor purchasing alcohol?
An offence under section 243 of the sale and supply of alcohol act
What obligations do licensed premises have in relation to been onsite out of hours
30 minutes unless you’re an employee. Under section 256
What is vicariously liability?
If a worker breaches the license then the manager is responsible as well
What are the defences for supplying alcohol to minors
Parents or caregivers give it to them in a responsible manner
Believes on reasonable grounds they’re not a minor
Believes on reasonable grounds they have permission from their guardian
What is the penalty of selling alcohol to a minor
Can be up to
10k to the company
2k for the person
7 day license suspension
What ID is appropriate for buying booze
Passport
Drivers license
Kiwi access card
What is the offence of allowing intoxicated people to remain on premises and what are the legal defences?
Section 252. Up to a 5k fine for company / manager.
The defences are if the company takes necessary steps to take the person to a place of safety
What is section 266 of the sales of alcohol act and how long can police close a premises for
Section 266 gives police the ability to be able to close a bar if there is serious fighting, rioting etc. must be within 24 hours if the incident
What powers do you have to demand details inside a venue
If you believe someone is under 18 you can demand name, dob and address under section 269
What is section 267 of the sales and supply act
The power to enter any bar to check whether they are abiding by their licensing conditions
What power under the policing act allows you to detain intoxicated people what criteria should be satisfied prior
Section 36 of the policing act. Criteria says person must be incapable of protecting themselves, causing physical harm or causing significant damage
What is the maximum period for detaining an intoxicated person
Up to 12 hours or until the person is no longer intoxicated
How many relevant offences do youth get before their car is impounded as a result of eba?
No number. Relevant offences aren’t relevant for youth in the eba process
Who can have unopened alcohol in a public place if on their way home to consume?
Anyone regardless of age
What is a right of someone who is detained for detox
The right for 1 phone call. Can be to family, not just a lawyer
Under section 266 of the sale and supply of liquor act, how long can police close a venue for?
24 hours
What age can a youth or child legally consume alcohol?
No set age as long as responsibly managed

Minor FOUND in restricted/supervised area

Supply to young. Serving alcohol to minors

Too much wine. Allows a person to become intoxicated
