What are the Aims of sentencing?
Proper –> Punishment
Rules –> Reform and rehab
Prevent –> Protection
Real –> Reducing crime
Mayhem –> Making reparations
What is the aim of punishment?
The aim of punishment is to proportionally fit the crime.
E.G. murderer will be given a mandatory life sentence
What is the aim of Reform and Rehab
The aim of Rehabilitation is to fix the unerlying problem with D that is making them commit crime. If they are “fixed” then they won’t commit crime anymore.
E.G. Community orders with conditions to attend drug rehab.
What is the aim of Protecting the Public?
The aim is to protect the public from dangerous or persistant offenders
E.G. A whole life order is given for child murderers or serial killers. And if D has 2 previous burglary convictions then the judge has to impose a minimum of 3 years fixed term prison sentence
What is the aim of Reducing Crime through Deterrence
- The aim of reducing crime through deterrence is to stop repeat offenders from committing crime through things like suspended sentences. D will know that if he re offends then he will be punished for both offences.
- They also try to prevent new offenders through harsh sentences.Like how judges can impose a discretionary life sentence for s18 GBH
What is the aim of Making Reparations?
The aim of Reparations is to try and make what D did “right” by often compensating the victim.
E.G. Community orders with a condition of unpayed work or an order to pay the victim ocmpensation for injuries or stolen goods.
