Types of sentencing aims
- Retribution (punishment)
- Rehabilitation and reform (helping individual)
- Reparation (compensation)
- Deterrence (discouragement from committing crime)
- Protection of the Public
Retribution
Is based in the idea of punishing the offender either by imprisonment, community services, fines
- the sentence should be proportionate with the seriousness of the offence committed
- punishment imposed only on the ground that an offence has been committed
Rehabilitation
This is about helping the offender to change their behaviour and mentality so that it prevents them from committing further crimes
Examples: Mental health institute, counselling, therapy, medical attention
Aims to reform the individual/offender into society
Reparation
This is based on the idea that the offender should pay for the compensation for the harm done and so compensating the victim with money
-Repayment to the victim
Deterrence
Reduction in crime is achieved through deterrence which is the idea of discouraging the offender from committing that crime again
Can be achieved by giving fines or imprisonment
-offender is deterred through fear of further punishments such as by giving them extra long sentences
Protection of the public
Focuses on incapacitating the offender in order to prevent them from committing further crimes against the public
Make the offender incapable of committing further crimes/offences
Examples: long prison sentences
