Powers & Duties of Planning Director
A
- Enforce ordinance through proper legal channels

- Make recommendations to the Winona County Board based on ordinance requirements

A
- Authority to order the issuance of variances, hear and decide appeals from and review any order, requirement, decision or determination made by the Planning Department, order the issuance of permits for buildings in areas designated for future public use on an official map
- Authority to grant variances to the vehicular access requirements of the Floodplain Ordinance

Criteria for Granting a Permit/Certificate
A
- Proposed use in not in conflict with the Comprehensive Plan of Winona County
- Proposed use is consistent with the purpose of this ordinance and the purpose of the zoning district in which the applicant intends to locate the proposed use
- Proposed use satisfies the performance standards and criteria of ordinance
- Proposed use has been described in sufficient detail to enable Planning Dept review

Permit Conditions
A
- Includes an Erosion and Sediment Control Plan and a Stormwater Management Plan that complies with performance standards
- Applicant shall provide documentation of the stormwater easement if permanent stormwater management involves directing some or all focused runoff from the site to another’s property
- Sediment control practices on all down gradient perimeters must be established before any up gradient land disturbing activities can take place and shall remain in place until final stabilization
- Any proposed modification to approved plans, construction schedules or alterations to accepted sequencing of land disturbing activities shall be approved prior to implementation
- Permittee shall notify Planning Dept prior to commencing land disturbing activities when erosion prevention and sediment control practices are to be put in place

Powers & Duties of County Feedlot Officer
A
- Administer and enforce county Feedlot ordinance
- Issue construction short form permits and interim permits
- Receive and forward applications for State administered permits together with county recommendations to MPCA
- Supervise the management of all necessary records including those related to feedlot and manure management and construction of manure storage and runoff control structures and/or practices
- Consult with SWCD, NRCS MPCA and private consultants as necessary to ensure construction standards are followed on manure handling and runoff control structures
- Maintain a record of all permits and registration material
- Educate the public and feedlot operations to issues of the ordinance
- Oversee the inspection of feedlot operations to ensure compliance
- Consult with other County departments, State and Federal agencies, and private consultants as needed to discharge these duties
- Fulfill the requirements of a county feedlot pollution control officer
