ACTUS REUS (THEORY) Flashcards
Actus reus is….
Something an individual does that is a criminal offence
What are the 2 types of causation and what do they mean?
Legal Causation: Thin Skull Rule, Chain of Causation
Factual Causation: Would not have happened ‘but for’ the fact
What is the thin skull rule?
D must leave the victim as they were found. If V has a condition which worsens condition D is liable for further injury
What is the chain of causation and what can it be broken by?
Needs to prove legal and factual to avoid innocent people from being convicted.
- an act of a 3rd party
- victims own act
- natural but unpredicted event
Victims own act:
D causes victim to react in a foreseeable way then any injury to V will be caused by D.
Natural but unpredictable event:
Natural hazard / event that caused something to happen
