The Act imposes a General Duty upon employers to provide, within the bounds of practicability, a working environment where employees are not exposed to hazards. In addition, the Act specifies particular matters which must be addressed.
Describe the duties of employers to their employees regarding these particular matters as prescribed in the Act.
The Employer & Mine Manager must, as far as practicable, provide & maintain a mine workplace environment that does not expose its employees and all other persons at the mine to hazards.
This is provided through:
- Provide & maintain workplaces, plant & systems of work to a kind that does not expose its employees to hazards.
- Provide information, instruction, training & supervision such that employees can complete their work without exposing themselves to hazards.
- Consult & cooperate with OHS Representatives & all other employees about OHS issues at the mine.
- Where exposure to hazards cannot be avoided, provide adequate & correct PPE/C to its employees to protect them from hazards - at no cost to the employee.
The Employer & Mine Manager must also establish systems for:
-Use, cleaning, maintenance, transportation & disposal of plant.
-Use, handling, processing, storage, transportation & disposal of substances.
In a manner that does not expose its employees to hazards.
(a) What are the general duties of employees as required under the provisions of the Act?
(a) An employee at a mine must take reasonable care:
- To ensure their own safety at work.
- To avoid adversely affecting the health & safety of any other person through any act or omission at work.
(b) List 4 specific means by which an employee could contravene the general duty of an employee?
(b) 1. Fails to comply with the instructions given by their employer or Mine Manager for the health & safety of themselves and others.
2. Fails to use PPE/C as provided by the employer in a manner in which they were properly instructed to use it.
3. Misuses or damages any equipment provided in the interest of safety or health.
4. Being an underground worker, fails to report to Shift Supervisor or cross shift on the state of the workings before leaving work.
(a) What are the duties of Principal Employers and managers towards persons at mines?
The Principal Employer and Mine Manager must take such measures as are practicable to ensure people who are at the mine, or use the means of access or egress of the mine are not exposed to hazards.
(b) The Act places duties on a person who designs, manufactures, imports or supplies any plant for use at a mine. List these duties.
A person who designs, manufactures, imports or supplies any plant must ensure:
- Design and construction of the plant is such that persons who properly install, maintain or use the plant are not exposed to hazards.
- Test, examine or arrange for testing and examination of the plant.
- Ensure adequate information in respect of:
- Dangers associated with the plant.
- Specifications of the plant and test results.
- Conditions necessary for persons properly using the plant.
- Proper maintenance of the plant.

A person who designs or constructs any constructs any building or structure must, as far as practicable, ensure that the design and construction of the building or structure is such that:

are not, in doing so, exposing themselves to hazards.
