Impaired Professionals and a board appointed professional consultant
This consultant will
- be a licensee of the board
- education and experience in the identification, treatment, and rehabilitation of persons with physical or mental impairments
- act as a liaison btw the board & the treatment program.
Board my defer or dismiss corrective action if
progressing satisfactory on an approved tx program
can not apply this rule if convicted of a felony
Impaired professional program
enter into an agreement whether the suspension or revocation is stayed as long as they progress in program (and adheres to limits of practice)
failure to enter in to such an agreement shall disqualify the professional from impaired professional program and shall activate an immediate investigation and disciplinary proceeding by the board.
Impaired professional- If consultant (after consulting with the provider) decides not progressing
consultant will disclose to the board all relevant info re impairment
board will institute proceedings to determine if the stay (suspension or revocation) will be vacated.
If approved program provider makes a disclosure pursuant to this section
shall be exempt from civil liability
If peer, colleague, hospital, or healthcare facility has evidence that a professional has an addictive disease for which the professional is not receiving treatment, shall make a report to the board
(those in treatment capacity in approved tx program are exempt from mandated reporting requirements)
Any person who makes a report in good faith will be immune to civil liability.

one should make the report within “a reasonable time” from receipt of knowledge of impairment
Board will levy this penalty only after affording the accused party the opportunity for a hearing (Robin)

Practice of Psychology
- application of established principles of learning, motivation, etc (counseling, measuring, testing, consultation)
- measuring and testing
- Psychological methods
- psychological consulting
Necessity for Licensee EXCEPT for
- simple acts of persuasion
- persons licensed in another healing art
- qualified members of other professions-clergy, D&A counselors, LCSW, F&M,
- cannot limit those working in a prison, ,school psychologists (as far as such practice is part of the normal functions of his position )
- does not restrict TERM “social psychologist by any person who is licensed
- does not restrict those in academia
- does not restrict trainees as long as he designated himself as “intern” or “trainee” - Not to limit those on temporary assignment to the commonwealth
- does not restrict those in business who are just applying basic psych IO theory (selection, placement)
- does not limit clerical or admin people to help in duties essential to psychologists
- Does not limit school psychologists certified by Dept of Education from performing in private practice those acts which she is permitted to perform in the public and private schools.
- nothing prohibits psychologist from employing post-docs
- nothing prohibits from employing people with “graduate training in psychology”
