Who is an accomplice? One who…
w/ intent to commit principal and intent that principal commit CRIME
aids (lend car)
advises (tell lay out of bank)
encourages (kill joey!)
the principal in the commission of the crime charged (before or during)
What intent must accomplice have?
intent to assist and intent that crime be committed by the principal
What are accomplices liable for?
the crime itself
AND
all other foreseeable crimes
How can an accomplice who encouraged crime, withdraw?
repudiate encouragement
How can an accomplice who aided by providing assistance to principal (such as giving materials) withdraw?
do everything possible to neutralize this assistance (such as attempting to retrieve materials)
Alternate means of withdrawing?
contact police
If don’t KNOW something is a CRIME…
can’t be accomplice b/c must act with intent that CRIME be committed
Rule as to sale of ordinary goods at ordinary prices
absent statute, if know that crime MIGHT result from sale of ordinary goods at ordinary prices, NO accomplice liability
