What are drivers duties at scene of accident?
a) stop vehicle
b) remain at or near for a time considered reasonable
c) give to any constable or person with reasonable grounds to ask for them
i) name and address. ii) name and address of owner iii) number plate
d) if not able to do above should report to police. If an injury report to police. If vehicle is a motor vehicle then produce insurance
According to article 175 RTO what is a reportable accident?
If owing to the presence of any Motor vehicle on a road or other public place, an accident occurs whereby:
a) injury is caused to any person other than the driver
b) injury is caused to any animal other than one carried in or on or belonging to driver
c) damage is caused to any property other than and property in or on vehicle or property belonging to the driver or owner of the vehicle
Does someone have to be at fault to fulfil owing to presence on a road?
No. Just prove it was there on road or other public place
What is meant by “public had access”- “public place”
Any road may be regarded as a road to which the public has access upon which members of the public are to be found who have not obtained access either by overcoming a physical obstruction or in defiance of a prohibition expressed or implied
Does there always have to be a collision to be an accident?
No. Eg person overtakes another vehicle without seeing an on coming cyclist. Cyclist swerves to avoid but falls off bike causing cuts. This is RTC but no collision occurred
